Age Discrimination in Employment Act
- Originally included as part of Title 7,
Congress directed Secretary of Labor to develop
- Follows Title 7; EEOC took
over responsibility for enforcement in 1978
- 1974 Amendments extended to public employees
- 1978 Amendments prohibited mandatory retirement and extended
protected age class from 65 to 70
- 1986 Amendments eliminated upper age limit of 70 (pre 1986
cases need to be read with this in mind)
- 1990 Amendments required age-based differences in benefit
plans to be adjusted by costs and similar changes
- ADEA (Age Discrimination in Employment Act) follows FLSA and
adopts Portal-to-Portal Act [29 U.S.C.A. 626(e)(1)]
